Privacy Policy

INTRODUCTION

This document sets out the rules relating to operations on personal data on the website www.euro-ekol.com.pl (hereinafter: Website).

BACKGROUND INFORMATION

  1. The administrator of the personal data within the scope of the Website is EURO-EKOL MYJNIE BEZDOTYKOWE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ SPÓŁKA KOMANDYTOWA with its registered office in Łódź (92-412), at 186D Rokicińska Street, entered by the District Court for Łódź Śródmieście in Łódź, XX Economic Division into the Register of Entrepreneurs of the National Court Register under number 723726, NIP: 7282828327 (hereinafter: EURO-EKOL).
  2. Personal data is processed by the Controller (definition below) in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: the Regulation).
  3. In connection with the User’s use of the Website, the Administrator collects and processes personal data in accordance with this privacy policy. Personal Data is information about a natural person identified or identifiable by one or more factors specific to, inter alia, physical, mental identity, including device IP, Internet ID and information collected through cookies or other similar technologies (hereinafter: Personal Data).
  4. The provision of Personal Data is voluntary, however, it is necessary, among other things, for the proper use of certain functionalities of the Website, to contact the Administrator.
  5. Users of the Website who provide the Administrator with personal data of third parties are also bound by the applicable legal provisions on the protection of Personal Data.
  6. The controller has not appointed a Data Protection Officer (DPO).

PURPOSES AND GROUNDS FOR PROCESSING PERSONAL DATA

The Personal Data of Website users is processed for:

  • to ensure security on the Website, to maintain the User’s session, to remember the User’s choices, to evaluate and analyse the User’s activity or choices – on the basis of the voluntary, informed, specific and unambiguous consent of the data subject or the legitimate interest of the Administrator (Art. 6(1)(a or f) RODO),
  • document archiving – on the basis that the processing is necessary for the fulfilment of the Administrator’s legal obligation (Article 6(1)(c) of the DPA),
  • responding within the framework of correspondence, fulfilling User requests (including complaints), realising the transfer of the prize obtained within the framework of the competition – on the basis of the necessity of the processing for the performance of the contract or taking action at the request of the data subject (Article 6(1)(a) and (b) RODO),
  • in order to establish and assert the Administrator’s claims or to defend against claims by Users and third parties – the legal basis for the processing is the Administrator’s legitimate interest (Article 6(1)(f) RODO),
  • the provision of commercial, advertising or promotional information relating to EURO-EKOL’s services and products, the sending of questionnaires and forms, the running of competitions – on the basis of a voluntary, informed, specific and unambiguous consent of the data subject (Article 6(1)(a) RODO).

SCOPE OF PERSONAL DATA

The scope of Personal Data collected and processed is divided into Personal Data:

  • given by users within the contact form: name, surname, telephone number, e-mail address, province, personal data provided in the comments/additional information,
  • obtained through cookies or similar technologies as a result of your activity on the Website: your IP address, time spent on the subpages of the Website, choices and preferences.

RETENTION PERIOD OF PERSONAL DATA

  1. The period of processing of Personal Data by the Administrator depends on the type of service provided and the purpose of the processing. As a general rule, data are processed for the time necessary to fulfil the purposes indicated above in this Privacy Policy or to comply with legal obligations. After the end of the processing period, the data are irreversibly deleted or anonymised.
  2. In addition to the above paragraph, Personal Data:
    • processed on the basis of separate legal regulations – until the time indicated in the specific legal regulation,
    • processed on the basis of a completed contact form – for the time necessary to reply and conduct the correspondence, and thereafter until the expiry of the statute of limitations for any claims arising from the correspondence,
    • processed on the basis of contracts concluded between the Administrator and the user of the Website – for the duration of the concluded contract, and thereafter for the period of the end of the statute of limitations for possible claims arising from the contracts,
    • processed for the Administrator’s financial accounts – for 5 years from the beginning of the year following the financial year in which the payment related to the executed contract occurred or in which the payment was settled or barred,
    • processed for marketing, commercial, advertising or promotional purposes relating to the services and products of EURO-EKOL, sending surveys and forms, running competitions – until you withdraw your consent or express your objection,
    • related to the analysis of the web traffic, maintenance of the User’s session, which are collected through cookies or similar technologies – until the removal of cookies or similar technologies from the Website user’s device; some Personal Data is not removed with the removal of cookies – in this situation, the data will be processed until an objection is made to the Administrator or the technology provider.

USER RIGHTS

The Website user has the right to request:

  • access to his/her Personal Data (Article 15 RODO); in exercising this right, the Website user is entitled to obtain from EUROEKOL Myjnie Bezdotykowe confirmation as to whether his/her Personal Data is being processed; to obtain a copy thereof and to obtain information on, inter alia: the purposes of the processing, the categories of Personal Data, the categories of recipients to whom the Personal Data has been or will be disclosed, the planned storage period of the Personal Data, the source of their acquisition by EURO-EKOL,
  • to rectify or correct their Personal Data (Article 16 of the RODO); in exercising this right, the Website user is entitled to request EURO-EKOL to rectify or complete personal data concerning them that is incorrect or incomplete,
  • erasure of his/her Personal Data (Article 17 of the RODO); in exercising this right, the Website user is entitled to request EURO-EKOL to erase the Personal Data concerning him/her in the cases indicated in Article 17 of the Regulation, in particular if the Personal Data is no longer necessary for the purposes for which it was collected or an effective objection to the processing of the Personal Data has been lodged,
  • to restrict the processing of his/her Personal Data (Article 18 RODO); if the Website user has objections to the accuracy of his/her data; if he/she believes that EURO-EKOL should not process his/her data, but at the same time does not want him/her to delete it; if such personal data is no longer needed by EURO-EKOL, but the Website user needs it in connection with the assertion of claims; if the Website user has objected to the processing of his/her data, and it is EURO-EKOL’s duty to verify whether it should continue to process it,
  • to object, on grounds related to his/her particular situation, to the processing of personal data on the basis of legitimate interests pursued by EURO-EKOL, as well as to object to the processing of personal data for the purposes of direct marketing by EURO-EKOL; in exercising this right, the Website user is entitled to object, on grounds related to his/her particular situation, to the processing of personal data of the Website user on the basis of legitimate interests pursued by EURO-EKOL; in spite of the objection, EURO-EKOL shall be entitled to continue to process the personal data if it demonstrates the existence of compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or grounds for the establishment, assertion or defence of claims,
  • withdraw consent to the processing of your Personal Data at any time; withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal
  • request the transfer of your Personal Data to another organisation,
  • lodge a complaint with the President of the Office for the Protection of Personal Data with regard to their Personal Data.

RECIPIENTS OF PERSONAL DATA

Personal Data of Website users may be transferred:

  • to other entities that process personal data on behalf of the Controller or as instructed by the Controller,
  • providers of IT, financial and accounting, legal, marketing and transport services,
  • to other processors of personal data in cases where the obligation to communicate such data arises from applicable legislation.

TRANSFER OF PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

  1. Personal Data collected as part of the Website will generally not be transferred outside the European Economic Area.
  2. The Administrator may transfer Personal Data outside the European Economic Area, but only if this is necessary for the proper functioning of all the functionalities of the Website and with an adequate degree of protection provided by these recipients, in particular by:
    • to have their place of establishment in countries for which a relevant decision of the European Commission has been issued concerning the determination of an adequate level of protection for Personal Data,
    • the use by these entities of standard contractual clauses issued by the European Commission,
    • the application by these entities of binding corporate rules approved by the competent supervisory authority.

SECURITY OF PERSONAL DATA

  1. The Controller conducts ongoing and appropriate risk analysis to ensure that Personal Data is processed by the Controller in a secure manner – ensuring, in particular, that only authorised persons have access to the data and only to the extent necessary for the performance of the tasks. The Controller shall ensure that all operations on Personal Data are recorded and carried out only by authorised persons.
  2. The Administrator emphasises that no method of transferring data via the Internet or storing them electronically is fully secure. Therefore, the Administrator does not guarantee absolute protection of data, including Personal Data, from unauthorised disclosure.

COOKIES AND OTHER TECHNOLOGIES

    1. The Administrator with regard to the Website collects and processes information or Personal Data through cookies and similar technologies.
    2. Cookies are small pieces of text that the Administrator or other cookie providers send to the User’s browser, which the browser sends back the next time the User accesses the Website or a third party website. These tools are used, among other things, to collect information about the User’s device and his/her visit for security purposes.     3. In many cases, the web browsing software (web browser) allows cookies to be stored on the User’s terminal device by default. The User may change their cookie settings at any time. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the web browser settings or inform about their placement on the User’s device each time.     4. The information obtained through cookies and similar technologies is not combined with the Personal Data of Website users provided through other channels, nor is it used to identify them by the Administrator.
    5. The Website uses the following types of cookies for the purposes set out below:
      • permanent cookies – are stored on the User’s device and remain there until deleted; they provide optimisation and selected settings for the Website,
      • session cookies – temporarily stored until the end of the browser session; they are necessary for the proper functioning of the Website,
    6. The Website uses:
      • essential cookies – necessary for the functioning of the Website, which cannot be switched off in order to use the Website,
      • analytical cookies – allows to measure the number of visits and to collect information about the traffic on the Website, collected in order to improve the quality and performance of the Website; may be used by the Administrator or by third party cookie providers,
      • Functional cookies – allows marketing activities to be tailored to the needs and preferences of the Website user; may be used by the Administrator or by third party cookie providers,
      • advertising cookies – used to promote products, also on other websites of third-party cookie providers, according to the relevance and preferences of the User, and to prevent duplicate advertising; may be used by the Administrator or by third-party cookie providers.
    7. The User of the Website consents to the cookies used within the Website, in particular in the window (banner) of the cookies. Consent to cookies is divided into consent to all cookies or consent to specific types of cookies, as indicated in the previous paragraph of the Privacy Policy, with the exception of essential cookies. The User may change the scope of consent to cookies on the Website at any time or delete them himself from his own terminal device. Use of the Website with acceptance of all cookies and similar technologies implies consent to their use for the purposes set out in the Privacy Policy. Disabling or restricting the use of necessary cookies may result in the prevention of, or difficulties with, the use of certain functionalities available on the Website and other cookie providers that are used within the Website.
    8. In addition to cookies, the Administrator may also collect data customarily collected by web system administrators as part of so-called logs or log files.
    9. Some subpages within the Website and other means of communication made available by the Administrator may contain so-called “web beacons” (so-called electronic images). Web beacons make it possible to obtain information such as e.g. the IP address of the computer to which the page to which the web beacon has been posted has been loaded, the URL number of the page, the time the page was loaded, the type of browser, as well as information contained in cookies. This data will not be combined with the Personal Data provided by the User.

Description: Google reCAPTCHA serves to protect the Website from automated access, abuse and spam by verifying that actions on the Website are performed by a human being. The processing of this data is carried out in accordance with Article 6(1)(f) of the RODO, on the basis of the Administrator’s legitimate interest in protecting the Website from abuse, bots and spam. A user who does not consent to the transmission of data to Google as part of the use of reCAPTCHA may block the operation of the service altogether by deactivating JavaScript in their browser settings, which may, however, limit or completely prevent the use of the Website functionalities protected by the reCAPTCHA service. In the case of data transfers to the United States, the provider has signed up to the EU-US Data Privacy Framework, ensuring compliance with the European level of data protection in accordance with the European Commission’s decision finding an adequate degree of protection for personal data.
